Terms of Service

These terms govern your use of BabyProof, a mobile application developed by LXGIC Studios. By downloading, installing, or using BabyProof, you agree to these terms. If you don't agree, don't use the app.

We've tried to keep this readable. Plain language where possible, legal language where necessary.

1. Using BabyProof

BabyProof is a tool that uses augmented reality and machine learning to identify potential hazards in your home that could affect infant and toddler safety. You can use it to scan rooms, receive safety scores, and get product recommendations.

You must be at least 18 years old to create an account. The app is intended for parents, guardians, caregivers, and childcare professionals.

You're responsible for the accuracy of the information you provide (like your child's age) and for keeping your account credentials secure.

2. Important Safety Disclaimer

BabyProof is NOT a substitute for professional childproofing services, pediatric safety consultations, or your own parental judgment.

Our app is a helpful tool, but it has limitations. No automated system can identify every possible hazard in every home. Factors like lighting conditions, room layout, unusual objects, and your child's specific behavior can all affect detection accuracy.

You should:

  • Always supervise young children regardless of safety scores
  • Consult professional childproofing services for thorough assessments
  • Use BabyProof as one tool among many, not your only safety measure
  • Not rely solely on the app's hazard detection or safety scores

3. AR Accuracy Disclaimer

BabyProof uses machine learning for object detection and hazard identification. Like all ML systems, it isn't perfect. You should be aware of these limitations:

  • False negatives: The app may miss hazards. A high safety score doesn't mean a room is 100% safe.
  • False positives: The app may flag objects that aren't actually dangerous in your specific situation.
  • Environmental factors: Poor lighting, reflective surfaces, cluttered spaces, and unusual objects can reduce detection accuracy.
  • Training limitations: Our models are trained on common household items and layouts. Unusual or region-specific hazards may not be covered.

We're constantly improving our detection models, but we can't guarantee 100% accuracy. Use BabyProof as a helpful supplement to your own safety checks — not a replacement for them.

4. Subscriptions and Payments

BabyProof offers free and paid tiers. Paid subscriptions are managed through the Apple App Store or Google Play Store.

  • Billing: Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
  • Price changes: We'll notify you at least 30 days before any price increase. You can cancel before the new price takes effect.
  • Refunds: We offer a 30-day money-back guarantee on all paid plans. After 30 days, refunds are handled according to the policies of your app store.
  • Cancellation: You can cancel anytime through your app store account settings. You'll keep access to paid features until the end of your billing period.
  • Downgrade: When your paid subscription ends, you'll revert to the free tier. Your scan history and room profiles are preserved.

5. Intellectual Property

BabyProof, including its design, code, ML models, and content, is owned by LXGIC Studios. You get a license to use the app — you don't own it.

You can't:

  • Reverse engineer, decompile, or disassemble the app
  • Copy, modify, or create derivative works
  • Use our trademarks, logos, or branding without permission
  • Resell, sublicense, or commercially exploit the app

Your scan data, room profiles, and report cards belong to you. We don't claim ownership of your data.

6. Limitation of Liability

To the maximum extent permitted by law, LXGIC Studios is not liable for:

  • Any injury, damage, or loss that occurs despite using BabyProof
  • Hazards that the app fails to detect (false negatives)
  • Actions taken based on the app's recommendations or scores
  • Product purchases made through recommendation links
  • Indirect, incidental, special, or consequential damages

Our total liability to you for any claim related to BabyProof won't exceed the amount you've paid us in the 12 months before the claim. If you're on the free plan, our liability is limited to $0.

Some jurisdictions don't allow these limitations, so they may not fully apply to you. In those cases, our liability is limited to the minimum extent permitted by law.

7. Warranty Disclaimer

BabyProof is provided "as is" and "as available." We don't guarantee that the app will be error-free, uninterrupted, or that its hazard detection will catch everything. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Acceptable Use

Don't use BabyProof to:

  • Violate any laws or regulations
  • Scan rooms or spaces you don't have permission to access
  • Attempt to circumvent subscription restrictions
  • Interfere with the app's operation or security
  • Create competing products using our technology or data

We reserve the right to suspend or terminate accounts that violate these terms.

9. Termination

You can stop using BabyProof at any time by deleting the app and your account. We can terminate or suspend your access if you violate these terms or for any reason with reasonable notice.

On termination, your license to use the app ends. We'll delete your server-side data within 30 days per our Privacy Policy.

10. Changes to These Terms

We may update these terms from time to time. If we make material changes, we'll notify you through the app and by email at least 30 days in advance. Continuing to use BabyProof after changes take effect means you accept the updated terms.

11. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Los Angeles County, California.
